We have updated our Terms of Use. Most of these changes deal with our name change to Feel Good Action.
Use of Site
These Terms of Use (also referred to as “Terms”) is a legal agreement between you (“you”, or “your”) and Feel Good Action (“Feel Good Action”, or “we”, or “our” or “us”). You agree that these Terms govern your access to the www.feelgoodaction.org website (“Site”), use of the Site’s features and functionalities for increasing participation in the democratic process (“Services”), and all materials you submit to the Site such as text, graphics, videos, audio, logos, or other information (“Content”).
You agree to accept and comply with these Terms of Use. If you disagree with any part of these Terms, then you may not access the Site, use the Services, or submit Content. Please read these Terms of Use carefully.
Privacy
Feel Good Action’s Privacy Policy describes the collection, use, and disclosure of personal information and the technologies used by Feel Good Action. You acknowledge that your use of our Site and Services are subject to our privacy policy, as such policy may be amended by us from time to time. Your Content
You may submit materials to the Site such as text, graphics, videos, audio, logos, or other information (“Content”). When you submit such Content, you agree as follows:
The name you provide is your real name and the email address is a working address that is checked regularly and can be used to receive Feel Good Action communications.
No compensation will be paid for any Content you submit to the Site. You or the owner of your Content still own the copyright in Content sent to us, but by submitting Content via the Services, you hereby grant us an unconditional irrevocable, non-exclusive, royalty-free, fully transferable, perpetual worldwide license to use, modify, adapt, reproduce, make derivative works of, publish and/or transmit, and/or distribute and to authorize other users of the Services and other third-parties to view, access, use, download, modify, adapt, reproduce, make derivative works of, publish and/or transmit your Content in any format and on any platform, either now known or hereinafter invented. You further grant us a royalty-free license to use your name, user name, image, voice, and likeness to identify you as the source of any of your Content.
You warrant that you (or another person or legal entity on whose behalf you are sharing the Content) own or otherwise control all of the rights to the Content you submit including, without limitation, all the rights necessary for you to provide the Content subject to the license described above.
You warrant that no Content you submit violates or infringes upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, breaches or conflicts with any obligation, such as a confidentiality obligation, or contains defamatory, or unlawful material.
To the fullest extent authorized by law, you will defend, indemnify and hold Feel Good Action, its officers, directors, employees, and agents harmless from and against any claims, actions or demands, losses, expenses, damages, and costs, including, without limitation, reasonable legal and accounting fees, alleging or resulting out of your violation of these TOS, including without limitation if any Content you submit violates any third party rights.
Feel Good Action reserves the right to make formatting and edits and change any Content. You waive any right to inspect or approve any finished product that incorporates your Content, including written copy that may be created in connection therewith.
You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.
Content Prohibitions
Feel Good Action may review Content submitted and may decline to post, delete, or remove Content (without notice) from the Site in its sole discretion, for reasons including but not limited to failure to conform to the Content prohibitions below.
The following is prohibited content and will not be approved:
Content that is partisan in nature, or that is considered lobbying or political campaign intervention under the US tax code;
Content that is obscene, defamatory, threatening, harassing, abusive, hateful, offensive, or objectionable, as determined in Feel Good Action’s sole discretion;
Content that incites violence or facilitates any activity intended to or likely to cause harm to people, businesses, or animals;
Automated scripts designed to interact with the Site or Services;
Content that contains files that contain viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful;
Content that infringes any third party’s intellectual property or privacy rights;
Content that consists of an advertisement or solicitation of business; or
Chain letters or pyramid schemes.
Copyright Policy
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Feel Good Action’s agent (listed below) the following information, in writing: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the exclusive right which is allegedly being infringed upon; (ii) identification of the copywritten work that is alleged to have been infringed upon or, if more than one, a representative list; (iii) identification of the material which needs to be removed or altered and a sufficiently detailed description of the location of the protected material on the Site; (iv) a sufficient means for Feel Good Action to contact you, such as your address, telephone number, and e-mail address (if available); (v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law and that you have authority to make such a statement; and (vi) a statement by you, made upon penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. Feel Good Action’s Intellectual Property
The Site and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of Feel Good Action.
The Site is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Feel Good Action.
Contests
Any Contests made available through the Site may be governed by rules that are separate from these Terms.
If you participate in any Contest, please review the applicable rules as well as our Privacy policy. If the rules for a Content conflict with these Terms, the Content rules will apply.
Your Feedback to Us
You assign all rights, title and interest in any feedback, innovations or suggestions sent by you to Feel Good Action regarding the attributes, performance or features of our Site or Services (“Feedback”). If for any reason such assignment is ineffective, you agree to grant Feel Good Action a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.
Links to Other Websites
Our Site may contain links to third-party sites or services that are not owned or controlled by Feel Good Action.
Feel Good Action has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You further acknowledge and agree that Feel Good Action shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such sites or services.
We strongly advise you to read the terms and privacy policies of any third-party sites or services that you visit.
Disclaimer and Limitation of Liability
You agree that:

Feel Good Action shall not be responsible for unauthorized access to or alteration of your material. Nor is Feel Good Action responsible or liable for any Content submitted by any third party (including claims of infringement related to that Content), for your use of the Site, or for the conduct of third parties on or through the Site.
The Site and Services are provided on an "as is" and "as available" basis without any warranties. Feel Good Action expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Feel Good Action makes no representations about the accuracy, reliability, completeness, or timeliness of the material presented on the Site or about the results to be obtained from using the Services. Changes are periodically made to the Site and may be made at any time.
Feel Good Action does not warrant that the Site will operate error-free or that the Site and its server are free of computer viruses and other harmful goods. If your use of the Site or the Services results in the need for servicing or replacing equipment or data, Feel Good Action is not responsible for those costs.
Feel Good Action does not control, nor can control, the flow of data to or from internet service providers, telecommunications providers and other portions of the internet. Accordingly, Feel Good Action disclaims any and all liability resulting from or related to events that impair or disrupt your connection to the internet or the accessibility of the site, whether or not caused by the fault or negligence of Feel Good Action.
In no event shall Feel Good Action, its suppliers, or any third parties mentioned on the Site be liable for any damages whatsoever (including, without limitation, incidental, special, punitive, and consequential damages, lost profits, or damages resulting from lost data or business interruption) or other economic loss resulting from the use or inability to use the site and the material, whether based on warranty, contract, tort, or any other legal theory, and whether or not Feel Good Action is advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the Site, or with any of these Terms of Use, your sole and exclusive remedy is to discontinue using the Site.
Dispute Resolution
If you have any concern or dispute about the Site or Services, you agree to first try to resolve the dispute informally by contacting Feel Good Action. In the event the dispute cannot be resolved informally, any and all such disputes will be settled solely and exclusively by arbitration in Seattle, Washington, United States of America, pursuant to the J.A.M.S./ENDISPUTE’s Streamlined Arbitration Rules and Procedures then in effect. Any decision rendered shall be final and conclusive upon both parties and a judgment thereon may be enforced in any court having jurisdiction. All costs incurred in arbitrating a dispute shall be shared in proportion to the parties’ respective amounts of liability. Notwithstanding the foregoing, Feel Good Action shall have the right to institute an action in any court or tribunal in the event you infringe Feel Good Action’s proprietary rights or breach any obligation respecting use of the Site and Services and shall be entitled to injunctive relief in any such action.
Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will make reasonable efforts to provide at least 30 days' notice prior to any new material terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access our Site or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Site and the Services.
